KWRA CURRENT CPI LITIGATION

The KWRA is challenging both Capital Improvement Petitions that are currently pending. We are asking the court:

  1. To reduce tenant's rent by rolling back the $179 currently being charged most tenants for the new windows.
  2. To require the housing provider to refund to the tenants, with interest and/or penalty, the total amount of the $179/month already collected from each tenant.
  3. To refuse to grant the housing provider the right to charge for the next round of proposed Capitol Improvements ($233).
  4. Based on our 1997 Agreement with the housing provider, to refuse to allow the housing provider (The B.F. Saul Company) to file any more Capitol Improvement petitions.

In three group tenant petitions filed by the KWRA challenging rent increases since February of 2003, the KWRA is asking the court:

  1. To reduce our rent through a roll-back of annual CPI-W increases in rent ceiling improperly taken and implemented in rent.
  2. To award refunds, with interest and/or penalty, for those unlawful increases.
  3. To reduce our rent through a roll-back of vacancy-based increases in rent ceiling improperly taken and implemented as rent.
  4. To award refunds, with interest and/or penalty, on those unlawful increases.

Individual tenant petitions:

There have been no rulings on any of the motions filed on behalf of individual tenants, and no hearing is scheduled. The KWRA will provide an update when there are any significant events in these proceedings.

Status Conferences/Case Hearing Dates:

  • Capital Improvement Petition II –
    Satuts Conference held April 30, 2007. The court announced that the hearing would be de novo because of two-year delay since it was first heard.


    Hearing Date set for: July 16, 2007

    To protect your rights, you must join the KWRA or represent yourself at the hearing (which has not yet been scheduled). If you are not represented, you may lose any remedy (i.e., you may have to pay the $233/month, even if the KWRA or individual tenants succeed in winning).


  • Motion to Consolidate Tenant Petitions - February 7, 2007
    — As of May 10, 2007 no decision has been reached.
